1. scope of application

the general terms and conditions govern the terms and conditions between customers and agua de dios klg. they contain the terms and conditions of sale and delivery of agua de dios klg and are part of the sales contract. the customer accepts these terms and conditions by placing the order. other terms and conditions shall only apply if they have been expressly accepted in writing by agua de dios klg.

 

2. offer

the offer of agua de dios klg is non-binding. we reserve the right to make changes to the product range. the offer is always made under the condition of delivery availability on the part of agua de dios klg at the stated prices. information on technical properties is provided without guarantee.

 

3. prices

for orders placed with agua de dios klg, the prices stated at the time of the order shall apply. these are in chf and include vat. prices are subject to change and will be communicated prior to delivery if necessary.

 

4. deviations and condition

agua de dios klg does not guarantee the images in the shop. individual products of agua de dios klg are made by hand; slight deviations in shape, condition and colour are therefore possible.

 

5. Registration

the customer is obliged to provide truthful information when registering in the shop.

 

6. orders

orders can be placed as follows: website, e-mail, telephone. when placing an order via the website or by e-mail or telephone, the customer places a binding order. the contract is concluded with the delivery of the ordered products.

 

7. postage and packing

switzerland: noting is charged for postage and packaging per order. abroad: there is no possibility to send the goods mentioned on the homepage abroad.

 

8. delivery

delivery is made at the customer's risk by post (switzerland) or by collection. the order is usually handed over to the post office within ten working days. this delivery period is not binding.

 

9. right of return

the customer can return all new products within 10 working days to the following address if they are not satisfied:

the right of return begins with the receipt of the products by the customer. the return shipment is at the customer's expense. excluded from the right of return are products that have already been used by the customer and products that have been damaged after received. In the event of a return, agua de dios klg will refund the purchase price. shipping costs will not be refunded.

 

10. payment

payment must be made either by credit card. agua de dios klg reserves the right to demand advance payment.

 

11. reservation of proprietary rights

the ordered products remain the property of agua de dios klg until full payment has been received. agua de dios klg is entitled to have the retention of title entered in the relevant register at the customer's place of residence.

 

12. protection of intellectual property

the brands, designs and products of agua de dios klg and partner brands are protected. reproductions and imitations are prohibited.

 

13. warranty

agua de dios klg offers a warranty of two years on new products. to enforce the warranty, the invoice must be presented. the customer has to inform agua de dios klg about defects immediately after discovery in written form. agua de dios decides in a warranty case whether a product will be repaired (also several times) or exchanged.

 

14. liability

agua de dios klg is only liable for gross negligence and intent. as far as legally permissible, liability is excluded for slight negligence as well as for damages that did not occur to the product itself (consequential harm caused by a defect), loss of profit and other financial losses. in particular, mandatory provisions regarding liability for personal injury and the product liability act shall remain reserved. liability does not extend to damage caused by improper handling, use or modification or by natural wear and tear of a product.

 

15. amendment of the gtc

agua de dios klg reserves the right to change the gtc at any time. the version valid at the time of the order shall apply in each case.

 

16. applicable law, place of jurisdiction and place of performance

all orders placed in the shop shall be governed exclusively by the substantive law of switzerland, to the exclusion of the vienna sales convention. the exclusive place of jurisdiction and performance for all orders in the agua de dios klg shop is bern (switzerland).

 

17. protection of your personal data

your data will neither be exchanged nor passed on to third parties.
